The
purpose of this inspection is to provide a general understanding of the
property condition. This inspection conforms to the Standards of Practice of
the Texas Real Estate Commission (TREC) that establishes a minimum level of
service performed. You should review these Standards of Practice (SOP: http://www.trec.state.tx.us/inspector)
and understand the requirements of the inspector set forth. The SOP
establishes the minimal expectations for the report content. Any
diversions from the SOP must be in writing and agreed to by both parties
Although the inspector may report
certain defects and safety concerns, it is important to understand that
this report is not a comprehensive safety inspection nor is it a comprehensive
defect/repair report.
In some limited circumstances,
TREC requires the inspector to compare the home to modern construction
standards and codes. Beyond these circumstances, identification of items
that do not meet current construction standards or codes are not within the
scope of this report. If any are mentioned, they are for informational purposes
only and are by no means exhaustive or comprehensive. For the purpose of this report the terms “appropriate” and
“proper” as used in the TREC Standards of Practice is defined as, “meeting
building practices customary to the region relative to the age of the item
being inspected”. The terms do not imply compliance to manufacturer
specifications or current construction standards or codes.
This inspection report reflects the condition of stated items at the time of
the inspection. This is a visual inspection and items that cannot be seen
or are unsafe to review are not included. Inspected By Bob Inc. will have
no liability for latent defects which cannot be observed by a normal inspection
nor can be determined by normal equipment operation; and it is specifically
agreed and understood that: Mechanical devices and structural components may be
functional one moment and later fail or malfunction. The inspection report may
not include minor settlement and minor crack in concrete veneer and walls that
would be within the normal tolerance or standard and does not impair the
structural function of the building. The inspection report may not include
cosmetic defects; minor cracks, scrapes, dents, scratches, soiled or faded
surfaces of the structure or equipment. Also, soiled, faded, torn or dirty
floor, wall or window coverings. The Inspection Report is not to be construed
as a total list of defects, existing or potential.
To formulate the opinions in the
report, the inspector will “look at and examine accessible items,
parts, systems or components without, except as required by the rules of the
Texas Real Estate Commission, laboratory, scientific or engineering evaluation
or testing, destructive tests or the dismantling or removal of parts, members
or components.” (See TREC SOP). Furniture, stored items, foliage, flooring or other items
are not moved for inspection purposes. It is important to understand that while
the inspection attempts to reduce your risk, it will not eliminate your
risk. As stated, this is NOT a comprehensive safety or building
standards/code report. The inspector does not inspect for building codes,
mold, mildew, soil analysis, adequacy of design, capacity, efficiency, size,
value, flood plain location, habitability, future life of components, or any
other topic not addressed by the SOP without explicit agreement. Any
mention of these or other topics in the report is strictly informational and is
not to be construed as a comprehensive analysis. Guarantees, warranties
or protection against errors and omissions are not expressed or implied.
To obtain guarantees or warrantees, we recommend you contact a home warranty or
insurance company. We recommend all issues raised in this report,
regardless of their apparent insignificance, be investigated by properly
trained and appropriately licensed specialists before acquiring the property.
This inspection report is prepared
for the sole use of the person or company named on the report (Prepared
For:, page 1). It is not transferable without explicit written
agreement by Inspected By Bob Inc. It is a general condition report
of the property at the time of the inspection and is not to be used for any
other purpose including but not limited to warranty, insurance, HUD, appraisal,
or any other third party. You agree to allow a representative of Inspected By
Bob Inc. to discuss this report with the Agents/Brokers involved in the
transaction for the purposes of clarification.
We want your experience to be as
pleasant as possible and will do everything in our power to explain and resolve
any issues or concerns you may have. If you feel you still have
difficulties, the following procedures will explain how to resolve them.
The client agrees to notify
Inspected By Bob Inc., in writing within fifteen (15) days from the presentation
of the report to the client, of any complaints or claims and agrees to allow a
prompt re-inspection of the item(s) in question. Otherwise, the client
waives all claims for damages arising from said complaints. Client
agrees that any damages for breach of this contract is limited to the amount
of the inspection fee. After the re-inspection, the client agrees
first to try in good faith to settle the dispute with Inspected By Bob
Inc. If that result is not satisfactory to either party, the client
agrees to binding mediation administered by the American Arbitration
Association under its Commercial Mediation Rules (http://www.adr.org). If
you sue or bring to arbitration any claim in which you do not prevail, you
agree to pay all reasonable fees incurred by Inspected By Bob Inc. to resolve
your claim including but not limited to attorney and arbitration fees.
