THE TEXAS STATE LEGISLATURE HAS TEAMED WITH THE INSURERS IN THE STATE AND BEGUN MANDATING AN E&O POLICY FOR ALL INSPECTORS.  THIS IS THE ONLY GROUP TARGETED WITH SUCH A REQUIREMENT AND WAS DONE WITH RELATIVE SILENCE.  TREC HAD ALWAYS MAINTAINED A FUND FOR DISPUTED INSPECTIONS YET THE LEGISLATURE AND THEIR FRIENDS IN THE INSURANCE BUSINESS HAVE MANDATED THIS COSTLY INSURANCE.

BECAUSE I HAVE BEEN DOING THIS AS A SIDE BUSINESS, BECAUSE I HAVE KEPT MY PRICES LOW, AND BECAUSE OF THE HIGH COST OF THIS INSURANCE, I CAN NO LONGER AFFORD TO HELP YOU IN YOUR HOME PURCHASE AS A LICENSED INSPECTOR.  IN THESE TOUGH ECONOMIC TIMES, THE TEXAS LEGISLATURE WOULD RATHER MAKE MONEY FOR THE INSURERS AND PUT SMALL BUSINESSES OUT OF BUSINESS.

THE END RESULT MAY BE FEWER INDEPENDENT INSPECTORS AND LESS CHOICE FOR THE CONSUMER.

AS OF 2/1/09 I HAVE APPLIED FOR AN INACTIVE LICENSE IN HOPES THAT THIS PUNITIVE LEGISLATION WILL BE REVOKED.  YES, THE STATE STILL REQUIRES ME TO PAY THEM TO HOLD AN INACTIVE LICENSE DURING THIS PERIOD.
